Why ISO and ITU-T Enforced Strict JPEG Patent Rules
The International Organization for Standardization (ISO) and the International Telecommunication Union Telecommunication Standardization Sector (ITU-T) instituted rigorous patent disclosure rules to safeguard the viability, adoption, and legal security of digital imaging standards. This shift was largely triggered by high-profile legal battles—most notably the costly patent assertions surrounding the original baseline JPEG format in the early 2000s—which revealed vulnerabilities in open standardization. By compelling early disclosure and clear licensing commitments, the organizations aimed to prevent patent hold-ups, eliminate hidden licensing liabilities, and guarantee that core multimedia standards remain accessible worldwide.
The Catalyst: The JPEG Patent Ambush
The primary driver behind strict patent reform was the controversy surrounding U.S. Patent 4,698,672, owned by Compression Labs and later acquired by Forgent Networks. In 2002, more than a decade after the original JPEG standard (ISO/IEC 10918-1 / ITU-T T.81) was finalized, Forgent began asserting that the widely deployed baseline JPEG standard infringed upon this patent.
Forgent initiated aggressive licensing campaigns and lawsuits against major technology companies, collecting over $100 million in royalties before the patent's key claims were largely invalidated by the U.S. Patent and Trademark Office. Because the original JPEG format was developed under the premise that it would be royalty-free, the dispute sent shockwaves through the technology sector, highlighting the danger of "submarine patents"—patents that remain undisclosed during the drafting of a standard, only to be weaponized once the market is locked in.
Preventing Patent Hold-Up
Standardization creates a unique legal and economic vulnerability known as patent hold-up. Once an international standard is finalized and widely integrated into hardware and software, switching to an alternative becomes economically unfeasible.
Without mandatory, early disclosure rules:
- Working group participants could steer the technical specification toward technologies covered by their own undisclosed proprietary patents.
- Standards developers could unknowingly incorporate patented techniques when non-patented, equally viable technical alternatives were readily available.
- End-users and implementers faced the threat of unexpected litigation and exorbitant licensing fees long after manufacturing and deployment.
To neutralize this leverage, ISO and ITU-T recognized that patent transparency had to occur during the drafting phase rather than after publication.
The Common Patent Policy
In response to the JPEG controversy and similar disputes in telecommunications, ISO, IEC, and ITU-T harmonized their approaches into the Common Patent Policy for ITU-T/ITU-R/ISO/IEC. Under this framework, strict obligations were placed on all participating entities:
- Mandatory Early Disclosure: Participants in standardization committees must disclose any known patents or pending patent applications (their own or third-party) that contain claims essential to implementing the draft standard.
- Licensing Declarations: Patent holders must formally state their licensing intentions via a standardized Patent Statement and Licensing Declaration form before the standard progresses to approval.
- Choice of Licensing Options: Rights holders must
commit to one of three pathways:
- Provide a free, irrevocable license to all implementers (Royalty-Free).
- Provide a license under Reasonable and Non-Discriminatory (RAND/FRAND) terms.
- Refuse to license, which triggers an immediate redesign of the standard to engineer around the patented technology.
Guaranteeing Royalty-Free Baseline Implementations
For the Joint Photographic Experts Group (JPEG), legal certainty is essential because digital image formats require ubiquitous, frictionless adoption across web browsers, operating systems, cameras, and consumer devices. Any standard burdened by licensing fees or legal ambiguities risks immediate market rejection in favor of unencumbered alternatives.
In subsequent projects—such as JPEG 2000, JPEG XR, JPEG XS, and JPEG XL—the committee enforced a strict baseline design philosophy: core profiles must be implementable on a royalty-free basis. By enforcing early disclosure, working groups can identify patented contributions immediately and either secure explicit, royalty-free licensing commitments from the contributors or proactively remove the proprietary algorithms before the specification is codified into international law.
