The Treaty-Backed Origins of JPEG
The Joint Photographic Experts Group was established in 1986 as a collaborative working group combining the resources of ISO, IEC, and ITU-T. The ITU-T is a specialized agency of the United Nations governed by international treaties signed by member states. By nesting the development of image compression within treaty-level bodies, the working group ensured that no single national jurisdiction or private corporation could claim exclusive authorship or control over the resulting baseline specification, officially designated as ISO/IEC 10918-1 and ITU-T Recommendation T.81.
The Common Patent Policy Shield
To prevent commercial entities from hijacking international specifications, the ISO, IEC, and ITU established the Common Patent Policy. This framework mandates that participants disclose any essential intellectual property rights early in the development phase. Furthermore, participants must commit to either licensing their essential patents on a Royalty-Free (RF) basis or under Reasonable and Non-Discriminatory (RAND/FRAND) terms. This multilateral rule structure prevented participating technology corporations from inserting proprietary, non-licensable choke points into the standard.
Defeating Predatory Patent Claims
The resilience of this international protection was tested in the early 2000s when Forgent Networks surfaced U.S. Patent 4,672,441. Claiming the patent covered baseline JPEG encoding, Forgent attempted to enforce licenses against hundreds of global tech companies, collecting over $100 million in settlements.
The defense against this corporate takeover succeeded directly because of the open, meticulously recorded nature of the standardization process:
- Documented Prior Art: Because the international committees conducted transparent proceedings and published draft proposals across multiple continents, standard advocates had a global repository of prior art.
- Coordinated Invalidation: Organizations like the Public Patent Foundation, supported by standardized technical records, petitioned the U.S. Patent and Trademark Office (USPTO) for re-examination.
- Legal Invalidation: In 2006, the USPTO largely rejected the patent's broad claims based on prior art predating the patent's effective filing dateāart that had been generated and preserved during international standard research.
