How Free Licensing Helped JPEG Compete with GIF

During the mid-1990s, the digital imaging landscape was upended when Unisys began aggressively enforcing its patent on the LZW compression algorithm used in GIF files, demanding licensing fees from software developers. This article examines how JPEG’s intentional design as an open, royalty-free standard eliminated legal liabilities for developers, accelerated its widespread adoption across web browsers, and firmly established it as the primary format for digital photography on the internet.

In 1987, CompuServe released the Graphics Interchange Format (GIF), which relied on the Lempel-Ziv-Welch (LZW) data compression algorithm. At the time, CompuServe and the broader developer community were largely unaware that Unisys held a 1983 patent covering the LZW technique. By late 1994, Unisys announced it would actively pursue royalties from any commercial software developer creating products that generated or displayed GIF images. This move—often referred to by developers as the "GIF tax"—sent shockwaves through the rapidly expanding World Wide Web community.

Small businesses, independent programmers, and open-source contributors suddenly faced the prospect of expensive licensing negotiations and potential litigation simply for supporting the web's dominant image format. The threat of legal action created an immediate demand for safe, unencumbered alternatives.

Unlike GIF, the Joint Photographic Experts Group (JPEG) format was established through an international standards committee that explicitly prioritized open access. The committee actively avoided proprietary, patented technologies during the standard's development, ensuring that baseline JPEG compression could be implemented freely by anyone without royalties or proprietary licensing agreements.

Because JPEG carried no licensing fees, browser developers like Netscape and Microsoft integrated native JPEG decoding into their software without financial penalty or legal friction. Software creators building image viewers, operating systems, and web design tools were incentivized to prioritize JPEG over GIF to avoid liability.

Beyond its legal advantages, JPEG offered superior compression for continuous-tone photographic imagery, supporting 24-bit true color compared to GIF’s restrictive 8-bit (256-color) palette. While GIF’s technical limitations were already a drawback for photographs, inertia had kept it popular. The Unisys patent dispute removed that inertia, making the switch to JPEG not only a technical upgrade, but an economic necessity.

By providing a dependable, cost-free standard, JPEG allowed the commercial and open-source web to flourish without patent encumbrances. The lack of patent fees protected software creators, reduced barriers to entry for early web development, and solidified JPEG’s position as the foundational format for online photography.
