Forgent Networks JPEG Patent Controversy Explained
Between 2002 and 2006, software firm Forgent Networks sparked one of the technology sector's most notorious legal battles by claiming that U.S. Patent 4,698,672 covered the universally adopted JPEG image compression standard. Because the tech industry had treated JPEG as an open, royalty-free format since its debut in the early 1990s, Forgent’s aggressive enforcement campaign targeted dozens of global hardware and software companies. The multi-year controversy resulted in over $100 million in collected licensing fees before a formal challenge by public interest groups and the United States Patent and Trademark Office (USPTO) dismantled the patent's critical claims.
Origins of the Patent
U.S. Patent 4,698,672, titled "Run length and code division multiplexing," was filed in October 1986 and granted in October 1987 to inventors Wen-hsiung Chen, Daniel J. Klenke, and C. Eric Li. The rights originally belonged to Compression Labs, Inc. (CLI), a video-conferencing technology company. In 1997, CLI was acquired by VTEL Corporation, which eventually rebranded as Forgent Networks.
The patent described a method for compressing digital signals to optimize data storage and transmission, primarily developed with digital video teleconferencing in mind.
The Royalty-Free JPEG Standard
The Joint Photographic Experts Group finalized the baseline JPEG standard (ISO/IEC 10918-1) in 1992. Intended to be an open international standard, it quickly became the foundational image format for the burgeoning World Wide Web, digital cameras, operating systems, and image-editing software. For roughly a decade, hardware manufacturers and software developers implemented JPEG compression without any patent licensing demands from Compression Labs or Forgent Networks.
Forgent’s Monetization Campaign
In July 2002, Forgent Networks announced that its subsidiary, Compression Labs, held the exclusive rights to Patent '672, which it alleged was essential to implementing the baseline JPEG format. Forgent began approaching hardware and software vendors, demanding licensing agreements.
Because protracted patent litigation is often cost-prohibitive, many major corporations chose to settle rather than fight in court. Between 2002 and 2004, Forgent secured licensing deals with roughly 30 companies, extracting over $100 million in fees.
In April 2004, Forgent escalated the campaign by filing a massive patent infringement lawsuit in the U.S. District Court for the Eastern District of Texas against more than 30 prominent tech companies, including Dell, Hewlett-Packard, Apple, Canon, and IBM.
The Prior Art Challenge and Invalidation
The aggressive litigation prompted intense industry backlash and scrutiny. In November 2005, the Public Patent Foundation (PUBPAT), a non-profit organization focused on patent reform, formally requested that the USPTO reexamine Patent '672.
PUBPAT argued that the patent was invalid because the technology had already been invented and published prior to the patent's 1986 filing date. Among the cited prior art was the 1983 CCITT (now ITU-T) international standard for digital video coding, as well as several earlier academic papers—including publications written by the patent’s own named inventor, Wen-hsiung Chen.
In February 2006, the USPTO issued an initial determination rejecting all 46 claims of Patent '672, citing substantial prior art that anticipated or rendered the claims obvious. Later that year, the USPTO issued a final rejection against the primary claims asserted against JPEG implementations.
Resolution and Legacy
Confronted with the USPTO's reexamination findings and mounting legal opposition, Forgent’s litigation strategy collapsed. In late 2006, Forgent settled with the remaining defendants for a fraction of its original demands and agreed to abandon any further enforcement of the '672 patent regarding JPEG technology. The patent itself expired in October 2006, officially ending the threat.
The Forgent Networks dispute remains a landmark example of a patent holder attempting to exploit an established, widely adopted open standard. The controversy accelerated discussions surrounding patent reform, highlighted vulnerabilities in technology standardization processes, and reinforced the necessity of defensive patent pools to protect open-source and open-standard infrastructure.
