At the core of AOMedia's legal framework is the AOMedia Patent License 1.0. Every member company contributing to the AVIF specification—including Apple, Google, Microsoft, Amazon, Meta, and Netflix—grants an irrevocable, worldwide, perpetual, royalty-free patent license to any entity implementing the standard. This license applies to any commercial product, software, or service that encodes, decodes, or serves AVIF files, eliminating recurring per-unit or streaming royalties.

Coverage of Essential Patent Claims

The protection extends specifically to "Essential Patent Claims." These are patents owned or controlled by AOMedia members that are technically impossible to avoid when implementing the normative sections of the AVIF and underlying AV1 specifications. By covering these essential claims, the agreement ensures that commercial adopters cannot be sued for infringement simply for complying with the official standard.

Defensive Termination Provisions

To deter opportunistic litigation within the ecosystem, AOMedia includes a defensive termination clause in its licensing terms. If a third party or licensee files a patent infringement lawsuit against any implementer or member regarding an AVIF implementation, the plaintiff immediately loses their own royalty-free license to the technology.
